In impatient driver caused a potentially fatal accident for three children last week. Heavy traffic prompted a driver to swerve in an attempt to get around other vehicles. In doing so she crashed into two small children and then sped up and crashed into another child. The driver apparently tried to continue as she hit a Subaru station wagon and finally came to a halt 20 yards later. Emergency crews arrived to a gruesome scene. One child was conscious but in considerable pain lying in the road. Another was bleeding from a head wound under a nearby vehicle. The third lay lifeless after being slammed into a wall.

The accident has not proved fatal to any of the three, but they are listed in critical condition, with one in a coma. (Source: New York Injury News)

It’s hard to imagine what was so pressing on the driver’s mind that would cause her to be so reckless. Regardless of her reasons she should be held accountable civilly and criminally.

If you’ve been injured in some way, call us today to discuss your case at no charge. We can help!

A lot of personal injury cases settle outside of Court. However, if you do end up at trial, you’ve got to pull out all the stops to give yourself the best chance at winning. This includes using top expert witnesses to help the judge or jury see why your case is valid. Using expert witnesses is a great way to gain credibility and convince the Court that you’re entitled to compensation for your injuries. This is true in virtually any case. A recent article discusses the importance of expert witnesses and how to use them effectively.

In legal trials establishing a foundation means asking the expert on the witness stand to state his or her credentials and background and give factual reasons why he or she is qualified to be a medical expert witness. The same holds true in a personal injury case. In a personal injury case the two sides will discuss the severity of the injury and the long term consequences of the injury.

The plaintiff’s side will have an expert that will say the injuries are severe and the long term consequences will be dire. Whereas the defendant will present a witness who will say the injury may or may not be as severe as the plaintiff claims but the long term consequences will not be as dire as the plaintiff wants the jury to believe. This is not to say the medical experts weigh their testimony in favor of one side or the other.
